This Privacy Policy describes how Bertram Technology Solutions, LLC (“BTS,” “we,” “us,” or “our”) handles personal information through The True Contract mobile applications, web application at engage.thetruecontract.com, and public website at thetruecontract.com (collectively, the “Service”).

1. Scope and roles

This policy applies when you create or use an account, prepare or sign an agreement, receive a review copy, contact support, or visit our website. The subscriber controls the agreement information they enter about clients, signers, or other people. BTS processes that information to provide the Service and also acts as the business responsible for account, subscription, security, and support data.

If a business asks you to sign through The True Contract, that business may have its own privacy obligations and policies. Contact it directly about its reasons for putting your information into an agreement.

2. Information we collect

Account and business profile

Name, email, login credentials in hashed form, business legal name, address, phone, jurisdiction, logo, document signature, service catalog, fees, standard payment, timing, responsibility, and termination terms.

Agreement and party information

Prompts, project or equipment details, client and party names, roles, email addresses, terms, drafts, revisions, change-request history, customer-review copies, final agreement content, agreement status, and related communications.

Signature and evidence information

Drawn signature strokes, typed signer name, consent acknowledgments, server-recorded date and time, locked-content fingerprint, IP address, browser or device user-agent, and signing status. We also collect the device-reported signing location (latitude, longitude, accuracy, timestamp, and indicators the platform supplies about simulated location).

Device, usage, and security information

IP address, request timestamps, browser or operating-system information, API and error logs, authentication events, and records used to diagnose failures, prevent abuse, and protect accounts. We do not use third-party advertising trackers in the Service.

Subscription and transaction information

Plan, trial status, subscription status, expiration or renewal dates, and transaction identifiers. Apple, Google, or another payment provider processes complete payment-card information; we generally receive entitlement and transaction metadata rather than the full card number.

Support and privacy requests

Messages you send us, your email address, deletion-request details, verification information, and records of how we responded. The public deletion form also records the originating IP address for abuse prevention and request verification.

3. How we use information

  • create, authenticate, and administer accounts;
  • save business profiles, catalogs, agreements, revisions, and signing records;
  • generate and revise requested agreement language;
  • send customer-review copies and service communications;
  • capture signatures and optional signing evidence selected by the subscriber and accepted by the signer;
  • provide subscriptions, trials, and entitlement checks;
  • secure, troubleshoot, improve, and maintain the Service;
  • respond to support, privacy, legal, and account-deletion requests;
  • enforce our Terms and prevent fraud, abuse, or unlawful activity; and
  • comply with law and valid legal process.

We do not sell personal information, use agreement content for behavioral advertising, or share it for cross-context behavioral advertising.

4. AI-assisted drafting

When you ask the Service to generate or revise an agreement, relevant business profile data, party information, selected services, instructions, and existing draft text are transmitted to our AI service provider to produce the response. Do not enter sensitive information that is unnecessary for the agreement. AI output can be incomplete or inaccurate and must be reviewed by the parties before use or signature.

We use the OpenAI API as a service provider for this functionality. Our own use of agreement content is limited to operating, securing, supporting, and improving the Service as described here; we do not use agreement content to build advertising profiles.

5. Location and device permissions

The app requests location only in the signing flow to associate a device-reported place with a signature. It does not request background location or continuously track a device. The current in-person signing workflow requires a fresh device-reported location before submitting a signature. If access is denied or unavailable, the signature cannot be completed in the app at that time. The disclosure appears before permission is requested.

The current mobile build does not request camera access. If a future release offers optional signing photos, we will update this policy and the app-store disclosures and explain the purpose before requesting camera access.

6. When information is disclosed

We disclose information only as needed for the purposes described above:

  • Service providers. Hosting and infrastructure providers, AI processing providers, email-delivery providers, payment and app-store providers, and security or technical vendors process data for us under contractual or platform terms.
  • At your direction. A subscriber can email a review copy, show the agreement to signers, download a copy, or otherwise direct disclosure to parties and advisors.
  • Legal and safety. We may preserve or disclose information when we reasonably believe it is required by applicable law, a valid subpoena, warrant, court order, or other lawful process; needed to protect rights or safety; or necessary to investigate fraud or abuse. We review requests for facial validity and scope and may notify affected users when legally permitted.
  • Business transfer. Information may be transferred in a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets, subject to applicable notice and privacy protections.

Current core service providers include DigitalOcean for infrastructure, OpenAI for AI-assisted drafting, Mailgun for transactional email, and Apple or Google when you obtain or pay for the mobile app through their stores.

7. Storage choices and international processing

The Service offers encrypted server storage for agreement records and may offer device-held copies. Drafting, account, security, email, subscription, and signing functions still require some server processing even when a user chooses a device-oriented final-copy workflow. Review the storage selection shown for each agreement and retain your own copy when required for business or legal purposes.

We and our service providers primarily process information in the United States. If you use the Service from another country, your information may be transferred to the United States, where privacy laws may differ.

8. Retention

We keep account and agreement information while the account is active and as needed to provide the Service. Drafts and unsigned agreements are generally kept until you delete them or the account. Signed agreements and signature evidence may be retained until deleted by an authorized account user or through an account-deletion request, subject to backup cycles and any legal preservation requirement.

Security logs, transaction records, consent records, deletion-request records, and limited audit information may be retained for a reasonable period for fraud prevention, dispute handling, accounting, tax, security, and legal compliance. Backups are isolated from ordinary use and age out on a limited cycle. When retention is no longer necessary, information is deleted or de-identified.

9. Your choices and privacy rights

You can review and update business-profile information in the app, decide whether to proceed with the location-enabled in-person signing flow, control device permissions in operating-system settings, and request deletion of your account.

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of personal information; object to or restrict certain processing; or appeal a denied request. We do not discriminate for exercising privacy rights. Submit a request through the account-deletion page or email privacy@thetruecontract.com. We may verify identity and authority before completing a request.

If you are a signer or client whose information was entered by a subscriber, identify the subscriber and agreement in your request. We may direct the request to that business where it controls the record.

10. Account deletion

Subscribers can initiate account deletion from Account settings in the app or through our public deletion request. Deletion covers the account and associated personal information unless we must retain limited information for legal, security, fraud-prevention, tax, accounting, or dispute purposes. Deleting an account does not automatically cancel an Apple App Store or Google Play subscription; cancel recurring billing in the store where you purchased it.

11. Security

We use administrative, technical, and physical safeguards appropriate to the nature of the information, including HTTPS in transit, access controls, password hashing, secret management, encrypted fields for sensitive agreement content, and restricted production access. No system can guarantee absolute security. Use a unique password, protect your device, and notify us promptly if you suspect unauthorized access.

12. Children

The Service is intended for adults and business use and is not directed to children under 13. Users must be at least 18 years old and able to form a binding contract. We do not knowingly collect personal information from children through account registration. Contact us if you believe a child has provided information without appropriate authorization.

13. Changes to this policy

We may update this policy as the Service or law changes. We will post the revised policy with a new effective date and provide additional notice when a change is material and applicable law requires it.
